Preamble

All users of this site agree that access to and use of this site is subject to the following Terms and Conditions. By using duenorthfoods.co.nz or purchasing products or services from us, you accept these Terms and Conditions. If you do not agree to these Terms and Conditions, please do not use this site. You should read these Terms and Conditions in conjunction with our Privacy Policy.

Consumer Guarantees Act

Nothing in these Terms and Conditions limits your rights under the Consumer Guarantees Act 1993.

Jurisdiction

The laws of New Zealand apply to these Terms and Conditions. Any dispute arising in relation to these Terms and Conditions and your use of this site will be resolved in accordance with New Zealand law.

Changes to Terms and Conditions

We may change these Terms and Conditions at any time. Each time you use duenorthfoods.co.nz you are agreeing to the Terms and Conditions applicable at that time. We provide a link to these Terms & Conditions at the bottom of every page of the website.

Indemnification

You agree to indemnify, keep indemnified, defend and hold harmless Due North Foods On Line and its subsidiaries, affiliates and their respective officers, directors, employees, owners, agents, information providers and licensors (collectively the “Indemnified Parties”) from and against any and all claims, damages, liability, losses, costs and expenses (including legal fees) (whether or not foreseeable or avoidable) incurred or suffered by any Indemnified Party and any claims or legal proceedings which are brought or threatened arising from your use of, connection with or conduct on the website or any breach by you of these Terms and Conditions.

Prices

All prices are stated in New Zealand dollars (NZ$) and include Goods and Services Tax (GST). International purchases shipped to non NZ destinations are GST exempt. When paying by credit card the amount charged will be in New Zealand dollars, and your bank will convert the amount charged to the currency of the country the card is held in. International exchange rates fluctuate on a daily basis, but if you would like to know approximately how much you will be charged in your home currency, please refer to a currency converter of your choice. We reserve the right to increase or introduce new prices for our products and services at any time. In the event that a Due North Foods product is mistakenly listed at an incorrect price, Due North Foods reserves the right to refuse or cancel any orders placed for product listed at the incorrect price, whether or not the order has been confirmed and your credit card charged. If your credit card has already been charged for the purchase and you choose to cancel your order, Due North Foods will issue a refund to your credit card account.

Errors and updates

Stock availability is updated manually on our site at the first opportunity after the item becomes sold out. In most cases items can be restocked within five working days. In the event that we cannot restock an item we will contact you without delay to discuss options. We reserve the right to add or remove material, and correct errors. If you find any errors on any part of the Due North Foods site, please report them to webmaster@duenorthfoods.co.nz.

Payment

We have various options available for making payment for your order.

By using a credit card to purchase goods you warrant that:

  1. you are the legally named person on the card and the details which you have provided on the order are correct and valid.
  2. you are in the possession of your card at the time of ordering and you have not misplaced the card, nor has the card been stolen or cancelled.
  3. you have sufficient funds on the card quoted in order to complete the purchase.
  4. the order you are placing is a bona-fide order which you have every intention of completing.

If you choose to order online, you will be sent an automatically generated email to notify that we have received your order. This notice does not guarantee that the order is confirmed or approved.

Delivery Information

Some products including special order items or custom products may have delayed delivery times. If your order is required for a special event, or to ensure the best possible fulfillment on your order, we recommend that you call or email us to reserve the products you require. Our Customer Service Representatives are available to discuss payment options with you and they will advise on delivery timeframes.

At our discretion, we may choose not to deliver to a Post Office box or any address which we deem to be suspicious. If goods are being shipped to a person or address that is not the same as the cardholder and credit card billing address, we may contact you for security purposes.

Orders are processed daily up until 1pm and will be despatched within 3 business days of being received, unless your order is a special order item in which case this will be discussed with you via phone or email prior to processing. New Zealand orders will take up to 5 business days to reach you by courier providing stock is available at the time of ordering. Internationally the delivery time frame is between 10 and 21 working days depending on destination. We will inform you immediately of any delays. Within New Zealand, the entire time between your payment being received and your order being delivered should take no longer than 7 days. Please note that urgent shipping or oversize items may incur additional costs, which you will be notified of prior to despatch. Please refer to our Shipping Page for further details.

Due North Foods orders are always despatched using reputable delivery companies and couriers with strict delivery policies and schedules, and customers will be advised when orders are despatched and wherever possible tracking information provided. It is very rare for things to go missing, however if you are concerned that this may have happened, simply send us an email with your order number and we will immediately follow up with the delivery company involved.

Should you feel that your goods do not arrive in good condition, don’t hesitate to let us know, we do not sell products with damaged packaging, so if your items arrive in damaged packaging we need to know about this. When signing for packages please check the small print as to what you are signing, some courier tickets have in small print “received in good order and condition”, which when signed would void any later claim for damage. In these circumstances, either ask the courier to wait while you open and inspect the goods or simply write ‘subject to inspection’. It is important that goods are opened and inspected promptly after delivery, as most courier companies have tight limitations on claims after delivery.

If your order requires your signature on delivery, you must be available to receive your order in person when it arrives. If your unavailability leads to the deliverable goods being returned to us, then all shipment costs will be payable by you. We are not responsible for loss or damage to goods that are delivered to an address which has been supplied incorrectly.

Returns and Refunds

Please choose carefully as we are not obliged to accept returns or exchanges on products purchased through our website other than for faulty, damaged or incorrectly supplied goods.

For broken or damaged goods, please phone or email us and whenever possible, we will repair or replace any damaged or faulty goods, providing the damage is not caused through misuse. If repair or replacement is not possible, a full refund will be issued for the value of the damaged or faulty goods.

In any event, all returns, whatever the reason, must be by prior arrangement. Please contact us and you will be issued with a Return Authorisation reference which must be included with your return.

International Customers

International Customers, please be aware that any customs charges or conditions applicable in your state/ locality/ or country are your responsibility. Any customs duties, sales taxes and other regulatory charges are payable by the purchaser.

Website Security

Online security is paramount at Due North Foods and we understand just how important it is to you too. This is why we have made your security our primary concern. We do not receive, store or process your credit card billing details. All credit card transactions are seamlessly handled entirely by third party Digital Payment Solutions (DPS) Payment Express, the Visa accredited and bank approved secure internet payment gateway.

Privacy Policy

Due North Foods is committed to protecting the privacy of our customers. By using our site, you consent to our privacy policy. Your privacy is very important to Due North Foods. With that in mind, we have established and implemented information handling practices that we believe are consistent with the highest standards and best practices of organizations doing business on the Internet. This privacy policy describes the practices that apply to our site, including, specifically, the information we collect about you, when and how we collect that information and what may happen to that information.

Due North Foods uses a secure credit card system supplied and hosted by Digital Payment Solutions (DPS) for processing credit cards. All online credit card payments are processed by DPS. Due North Foods does not have access to, or store your credit card number when you make an online purchase.

The other personal information you may submit when placing your order is treated as confidential. Your details are used solely for the purpose of fulfilling your orders. Please note that we may maintain some information about an individual sales transaction in order to service that transaction and for record keeping as required by our bank.

We employ the use of Cookies on our site. Cookies are small files that a site or its service provider transfers to your computer's hard drive through your Web browser (if you allow) that enables the site's or service provider's systems to recognize your browser and capture and remember certain information. For instance, we use cookies to help us remember and process the items in your shopping cart.
